Medical vs. Recreational — The Official Rules

Most people walk in thinking “medical” and “recreational” are two different products. They aren't. Under California's cannabis laws they're two different legal pathways to the same lab-tested menu. What changes is your minimum age, how much you can buy in a day, what you pay in tax, and how strong a single package can be.

Pathway 01

Recreational, Adult-Use

Who qualifies
Any adult 21 or older. No physician, no registry, no membership — the state calls this “adult use.”
What you show at the counter
One valid, unexpired government-issued photo ID proving you're 21+.
Daily purchase limit
28.5 g (1 oz) of non-concentrated cannabis, 8 g of concentrate, and up to 6 immature plants per day.
Tax you pay
15% state cannabis excise tax (effective October 1, 2025), plus sales & use tax, plus any local cannabis tax.
Strength allowed per package
Edibles: 10 mg THC per serving, 100 mg per package. Non-edibles — vapes, concentrates, tinctures — up to 1,000 mg THC per package.
Growing at home
Up to 6 plants per residence if you're 21 or older.
Pathway 02

Medical, Medicinal Use

Who qualifies
Patients 18 or older with a valid recommendation from a California-licensed physician. The state MMIC card is optional and sits on top of that recommendation.
What you show at the counter
Your physician's recommendation and a matching photo ID. Bring your MMIC card too — it's the only way to get the tax break.
Daily purchase limit
Up to 8 ounces of medicinal cannabis in dried mature flower form per day — or more if your recommendation says so.
Tax you pay
Exempt from sales & use tax with a valid CDPH MMIC card plus government ID. The 15% excise tax still applies — there is no exemption from it.
Strength allowed per package
Same edible caps. But medicinal-only non-edibles may go up to 2,000 mg THC per package — double the adult-use ceiling.
Growing at home
6 mature or 12 immature plants per qualified patient — or more if the recommendation calls for it.

The Process, Step by Step

How to Get a Medical Marijuana ID Card in Los Angeles

A physician's recommendation is what makes you a medicinal customer. The MMIC — the state card issued by the California Department of Public Health — is a separate, voluntary card you apply for through your county. It's the card that unlocks the sales-tax exemption.

01

Get a written recommendation from a California-licensed physician

Your doctor documents that medical cannabis is appropriate for a qualifying serious condition — the state lists cancer, chronic pain, glaucoma, migraine, persistent muscle spasms, seizures, severe nausea and other chronic symptoms. See the CDPH MMIC Program.

02

Fill out the state form and gather your documents

Complete the CDPH 9042 application from the CDPH forms page. You'll also need a government photo ID, proof of Los Angeles County residency, and a recent passport-style photo.

03

Apply through LA County Public Health and pay the fee

LA County processes applications through its MMIC program. Fees are capped statewide at $100; Medi-Cal enrollees pay 50% less, and county medically-indigent participants can have it waived.

04

Use the card — and know it can be verified

Your MMIC is valid for up to one year and carries a nine-digit number. Show it with your photo ID at checkout for the tax exemption. Anyone can confirm a card is active at the state's MMIC verification site.

Recreational & Medical, Answered

The questions people actually ask at the counter — answered with California and Los Angeles government sources so you can check every one of them yourself.

What's the difference between recreational and medical at LAXCC? +
Recreational (the state calls it “adult use”) is for any adult 21+ with a valid photo ID — no card or paperwork needed. Medical (“medicinal”) is for patients 18+ with a valid physician's recommendation. Going medical raises your daily purchase limit to 8 ounces, opens up medicinal-only products with up to 2,000 mg THC per package, and — with a state MMIC card — removes sales & use tax from the bill. Both pathways shop the same store and much of the same lab-tested menu. See the Department of Cannabis Control.
Do I need a medical card to buy weed in Los Angeles? +
No. Adult-use cannabis is legal in California for anyone 21 or older — just bring a valid government-issued ID. A physician's recommendation is only required if you're 18–20, or if you want the medicinal benefits: the higher daily limit, medicinal-only product strengths, and the MMIC tax exemption. Per the DCC, medicinal customers must be 18 or older with a physician's recommendation.
Is a physician's recommendation the same thing as an MMIC card? +
No — and this is the single most misunderstood point. The recommendation comes from your doctor and is what legally makes you a medicinal patient. The MMIC is a voluntary state ID card issued by the California Department of Public Health through your county, valid for up to one year. You can be a medical patient with only a recommendation, but only the MMIC card removes sales & use tax at checkout. Details at the CDPH MMIC Program.
How much does a medical card actually save me? +
With a valid MMIC card and a matching government ID, your medicinal cannabis purchase is exempt from sales and use tax. The 15% state cannabis excise tax still applies — the CDTFA is explicit that there is no exemption from it. Whether the card pays for itself depends on how much you buy in a year against the county application fee (up to $100, halved for Medi-Cal enrollees). See CDTFA — Cannabis retailers.
How much can I buy in a single day? +
Under state regulations a retailer may sell an adult-use customer up to 28.5 grams (1 oz) of non-concentrated cannabis, 8 grams of concentrate, and 6 immature plants per day. A medicinal patient may buy up to 8 ounces of medicinal cannabis in dried mature flower form per day — or more if their physician's recommendation specifies it. See the DCC regulations and Health & Safety Code Section 11362.77.
Can medical patients buy stronger products? +
Yes, in one specific way. Edibles are capped identically for everyone at 10 mg THC per serving and 100 mg per package. But non-edible products — vapes, concentrates, tinctures — top out at 1,000 mg THC per package for adult-use, while medicinal-only products may contain up to 2,000 mg THC per package. Those are labeled “FOR MEDICAL USE ONLY.” See LA County Cannabis 101.
What ID do I need to bring? +
A valid, unexpired government-issued photo ID (driver's license, state ID, or passport). Medical patients — especially anyone 18–20 — should also bring their physician's recommendation, plus an MMIC card if you have one. Retailers may check an MMIC's nine-digit number against the state's CDPH verification system, so bring the card itself, not a photo of it.
What is still illegal in California, even for adults 21+? +
The state is clear on the limits: no using cannabis in public places, no smoking where tobacco smoking is banned, no smoking within 1,000 feet of a school, day care or youth center while children are present, no open container in a vehicle (keep it sealed or in the trunk), no driving under the influence — the penalties match alcohol DUI — and no taking cannabis across state lines. Full list at DCC — What's legal.
How do I check that a dispensary is legitimate? +
Look the shop up yourself. The Department of Cannabis Control runs a public, daily-updated license search that shows whether a business holds an active state license. In the city, the LA Department of Cannabis Regulation publishes its own list and map of retailers — a shop in Los Angeles needs both a city and a state authorization. Unlicensed shops sell untested product with no recall protection.
I'm new to this — how much should I take? +
The state's own guidance is “start low, go slow.” With edibles in particular, CDPH notes your body takes up to two hours to begin feeling the effects and up to four hours to feel the full effects — which is exactly why people take a second dose too early. Store everything in its sealed child-resistant package, away from children and pets. Read Responsible cannabis use and CDPH's Let's Talk Cannabis.
Where is LAXCC and what are the hours? +
LAXCC is at 8332 Lincoln Blvd, Los Angeles, CA 90045 — on Highway 1 between LAX and Santa Monica, about 5 minutes from the airport. Open daily, 9 AM–9:30 PM. Call (310) 429-3789.
Can I order online for pickup? +
Yes. Browse and reserve on the live menu, then pick up in store — the fastest way in and out. Walk-ins are always welcome too.
